Confederate Pension Application

G. W. Haynie

Note * The following is a transcription of photocopies received March 17, 2005 from Texas State Library and Archives Commission.  It is the application for Confederate Pension by George W. Haynie who lived in Montague Co, TX at the time of application in 1899.  Depositions had to be obtained from Calhoun Co, AL to complete the application process.  The Justice of the Peace in Calhoun Co, AL was E. J. Haynie who was probably Enoch J. Haynie, brother to George W. Haynie.

I have carefully examined the within application for pension, together with the proof in support thereof, and I recommend that the application be APPROVED this 6 day of February A. D. 1900.

THE STATE OF TEXAS
County of Montague

To the Honorable county Judge of Montague County, Texas.
    Your petitioner, G. W. HAYNIE respectfully represents that he is a resident citizen of MONTAGUE County, in the State of Texas, and that he makes this application for the purpose of obtaining a pension under the act passed by the Twenty-sixth Legislature of the State of Texas, and approved May 12, A. D. 1899, the same being an act entitled "An act to carry into effect the amendment to the Constitution of the State of Texas, providing that aid may be granted to disabled and dependent Confederate soldiers, sailors, and their widows under certain conditions, and to make an appropriation therefore," and I do solemnly swear that the answers I have given to the following questions are true.

Q.  What is your name?    A.  G. W. HAYNIE
Q.  What is your age?      A.  69 YEARS OF AGE JULY 22, 1899
Q.  In what County do you reside?  A.  MONTAGUE
Q.  How long have you resided in said County and what is your post office address?
        A.  15 YEARS.
Q.  Have you applied for a pension under the Confederate Pension Law heretofore, and been rejected?  If so state when and where.  A.  NO
Q.  What is your occupation if able to engage in one?  A.  FARMER
Q.  What is your physical condition?  A.  VERY BAD
Q. If you physical condition is such that you are unable by your own labor to earn a support, state what caused such disability.  A.  FROM A WOUND RECEIVED DURING THE WAR.
Q.  State in what company and regiment you enlisted in the confederate army, and the time of your service?  A. CO. D 31 REGT ALABAMA INFANTRY.  ENLISTED MARCH 1862 AND SERVED TO THE CLOSE OF THE WAR.
Q.  State whether or not you have received any pension or veteran donation land certificate under any previous law, and if you answer in the affirmative state what pension or veteran donation land certificate you have received.  A.  NONE
Q.  What read and personal property do you now own, and what is the present value of such property?  Give list of such property and value.  A.  I OWN TWO MULES WORTH $100.00, ONE WAGON WORTH $65.00, AND ONE COW AND CALF WORTH $30.00 AND HEIFER YEARLING WORTH $25.00.
Q.  What property, and what was the value thereof have you sold or conveyed within two years prior to the date of this application?  A. ONE YEARLING FOR $7.00 AND MY LITTLE CROPS OF COTTON.
Q.  What income, if any, do you receive?  A.  NONE
Q.  Are you in indigent circumstances; that is, are you in actual want, and destitute of property and means of subsistence?  A.  YES
Q.  Are you unable by your labor to earn a support?  A. I AM
Q.  Have you transferred to others any property of value of any kind for the purpose of becoming a beneficiary under this law?  A. NO
Q.  Did you ever desert the Confederacy?  A. NO
Q.  Have you been continuously since the first day of January, 1880, a bona fide resident citizen of this State?  A.  YES

    Wherefore your petitioner prays that his application for pension be approved and that such other proceedings be had in the premises as are required by law.

AFFIDAVIT OF PHYSICIAN
THE STATE OF TEXAS
County of MONTAGUE            Before me  P.P. DUNFORD  County Judge of MONTAGUE County, State of Texas, on this day personally appeared  M. F. SHERRILL,  who is a reputable practicing physician of this County, who being by me duly sworn on oath, states that he has carefully and thoroughly examined      G. W. HAYNIE, applicant for a pension, and finds him laboring under the following disabilities which render him unable to labor at any work or calling sufficient to earn a support for himself:  WOUND IN THE HIP JOINT WHICH CAUSED CHRONIC [CAXALGIA?] AND GENERAL LAMENESS WITH  OF THE LEFT HIP AND LEG TO THE EXTENT THAT SAID G. W. HAYNIE IS UNABLE TO DO ANY PART OF A DAYS LABOR.

CERTIFICATE OF COUNTY JUDGE
THE STATE OF TEXAS
County of MONTAGUE                I, P.  P. Dunford County Judge of MONTAGUE County, State of Texas, do hereby certify that on the 15th day of November A. D. 1899, before me came on to be heard the application of G. W. HAYNIE, for a pension under the confederate Pension Law of this State, approved May 12 A. D. 1899; that the answers of said applicant to the questions propounded (sic) were made under oath as the same appear in writing in the foregoing application; that the affidavits of the witnesses who are credible citizens were made before me as the same hereinbefore appear, and that the foregoing affidavit of Doctor M. F. SHERRILL, who is a reputable practicing physician of this County, was made before me.  I also certify that the said applicant G.W. HAYNIE, is not an inmate of the Texas confederate home, nor otherwise disqualified under the provision of Section 12, of the Confederate Pension Law.  I further certify that after considering all the proceedings had before me relative to the said application for a pension by the said G.W. HAYNIE I find the said applicant is lawfully entitled to the pension provided by the Confederate Pension Law of this State, and I hereby approve said application.

CERTIFICATE OF COUNTY COMMISSIONERS
STATE OF TEXAS
County of Montague        We, the undersigned members of the Commissioners Court of MONTAGUE county, Texas, hereby certify that the foregoing application of G. W. HAYNIE for a pension, together with the proof in support thereof, was duly submitted by Hon. P. P. DUNFORD County Judge of this MONTAGUE County, to the Commissioners Court of this MONTAGUE County, at a regular term thereof on the 17 day of Nov. A.D. 1899, and after a careful consideration of the same we find the said applicant is lawfully entitled to the pension provided for by the Confederate Pension Law of this State, and we hereby approve said application.

STATEMENT OF THE CASE:
Applicant  G. W. HAYNIE for confederate Pensions under Act of May 12, 1899, of the State of Texas applied for pensions and made Affidavit before me, on the 11th day of July A. D. 1899, to the following facts:
    That his name is     G. W. HAYNIE age 69 years, resides in MONTAGUE County, in the State of Texas, and resided in said county for fifteen years.
    Post office address is FORESTBURG, TEXAS,  That he never heretofore Applied for pension and been rejected.  That his occupation is FARMER, that his physical condition is VERY BAD  and is unable to earn a support by his own labor; cause of  his disability is FROM A WOUND RECEIVED DURING THE WAR; That he enlisted in the Confederate army in company D-31 REGT. ALABAMA Regiment ALABAMA INFANTRY on or about the  ____ day of MARCH 1962, and served for a term of TO THE CLOSE OF THE WAR, That he had no income.  That he is in indigent circumstances; In actual want and destitute of property and means of Subsistence; That he never deserted the Confederacy; and that he has been a bona fide resident citizen of the State of Texas, continuously since January 1st, 1880.

Crook, Judge of the Court of Probate, and ex officio Clerk of said Court, in and for the County of Calhoun and State of Alabama (said court being a court of Record), do hereby Certify, that E. J. HAYNIE whose name is subscribed to the Certificate of proof or acknowledgment of the annexed instrument, and thereon written, was at the time of taking such proof or acknowledgment, a JUSTICE OF PEACE of the State of Alabama, in and for the County of Calhoun, dwelling in said County, commissioned and sworn, and duly athorized (sic) to take the same; and further that I am well acquainted with the handwriting of such JUSTICE and verily believe the signature to the said Certificate of proof or acknowledgment is genuine.  And I further certify that said instrument is executed and acknowledged according to the laws of this State.

APPLICATION FOR PENSION.
The State of Texas
County of Montague.        Before me P.P. DUNFORD, COUNTY JUDGE of Montague County, State of Texas on this day personally appeared J. N. MORRIS and S. L. MORRIS who are personally known to me, to be credible citizens, who being sworn on oath, state that they personally know G.W. HAYNIE, the above named applicant for a pension, and that they personally know that he, the said applicant is physically unable to support himself by labor of any sort, to-wit:
HE HAS A GENERAL LAMENESS IN THE LEFT HIP AND LEG.  HE IS NOT ABLE TO DO HARD WORK.  And that they further know that he the said applicant is in indigent circumstances, to-wit:
THAT HE ONLY OWNS ONE SPAN OF MULES AND ONE WAGON WORTH ABOUT $165.00 AND THREE HEAD OF STOCK CATTLE.

Calhoun county       |        Witness in the matter of Application of G. W. HAYNIE for pension in the State of Texas.

1st Int.
My name is John E. Pruitt.  My age is fifty six years.  My occupation is farmer.  I reside at Jacksonville, Ala.
2nd Int.
I know G. W. HAYNIE the applicant for pension.  I knew him in Calhoun county Alabama.  I have known him for forty five (45) years.  When I last seen him I suppose he was near seventy (70) old.
3rd. Int.
I know the said G. W. HAYNIE served as a confederate soldier in the civil war in Co. D 31st Regiment of Alabama Volunteers.  I think enlisted in 1862 and served until the close of the (war?).  He was honorable discharged at Saulisbery, NC  (something is marked out) in April or May 1865.  I were discharged at the same time, and being a member of the same company & Reg. we come part of the way home together.
4th Int.
I do not remember the said HAYNIE being wounded while in the Service.
5th Int.
I know the said G.W. HAYNIE never deserted the confederacy. I was member of the same company & Regiment and were discharged at the same time from the service of the Confederate States.
Cross Int.
I do no of my own personal knowledge that G.W. HAYNIE served as a soldier in the service of the Confederate States in the Civil War.
