Gilbert Budd
Will Transcript

    In the name of God Amen.  I, Gilbert Budd of the town of Schondack County of Rensselaer and state of New York being of sound mind and memory and of perfect understanding do make constitute and ordain this to be my last will and testament in manner  (that?) and from following that is to say;

First I also give and bequeath to my beloved wife Fanny Budd all my household furniture to be at her disposal.

Secondly I give and bequeath to my beloved daughter Hannah Budd three hundred and fifty dollars to be paid within six months after my decease out of any real estate.

Thirdly I give and bequeath to my beloved daughters Betsey Budd and Abbey Budd five hundred dollars each to be paid out of my real estate within six months after my decease.

Fourthly I give and bequeath to my beloved daughter Polly the wife of Angerone Thorn three hundred and fifty dollars to be paid out of my real estate within six months after my decease.

Fifthly I give and bequeath to my beloved son James Budd one hundred dollars to be paid out of my real estate within six months after my decease and

Sixthly I give and bequeath to my beloved son Elijah Budd all the rest, residue and remainder of all my estate both real and personal to have and to hold unto the said Elijah Budd his heirs and assigns forever.  And I do hereby further order and declare that all the aforesaid legacies are to be paid out of the estate of Elijah Budd his heirs and assigns and

Lastly I do hereby constitute and ordain and appoint Elijah Budd and Fanny Budd Executor and Executrix of this my last will and testament hereby revoking all former wills and testaments heretofore made.  In testimony where I have hereunto set my hand and seal this fifth day of July in the year of our Lord one thousand eight hundred and twenty two.

I give and bequeath by my beloved wife Fanny Budd ( ? ? ) of all my real estate in the county of Rensselaer ( ? ) aforesaid to have and hold (?) said Fanny Budd (?) during her natural life.

Be it remembered that on the seventh day of December in the year of Our Lord one thousands eight hundred and twenty five before me Thomas Clowes Esquire, Surrogate of the said County of Rensselaer   Philip Harder one of the subscribing witnesses of the will of Gilbert Budd late of the town of Schondack in said county deceased who being duly sworn declared that he did see the said Gilbert  seal and execute the (annexed?) written instrument purporting to be the last will and testament of the said Gilbert bearing date the fifth day of July in the year of our Lord one thousand eight hundred and twenty two and heard him publish and declare the same as and for his last will and testament that at the time thereof he the said Gilbert was of sound and disposing mind and memory to the best of his knowledge and belief of the said Philip and that he the said Philip together with Peter P. Harder and Meshack Strait the other witnesses to the said will severally subscribe their hands and names to the said will and witness thereto in letter Testamentary granted unto Elijah Budd Extr. of Gilbert Budd   (received ? ) 7th Dec 1825

We the people of the state of New York by the Grace of God free and independent: to all whom these presents shall come and may concern send greeting.  Know ye that at the city of Troy in the county of Rensselaer on the seventh day of December in the year of Our Lord one thousand eight hundred and twenty five before Thomas Clowes Surrogate of our said county the last will and testament of Gilbert Budd late of the town of Schondack  in the county of Rensselaer and State of New York deceased a copy whereof is hereunto annexed was proved and is now approved and allowed by us and the said deceased having whilst he lived and at the time of his death goods chattels and credits within this state by means whereof the proving and registering the said will and the said will and the said will and the granting administration of all and singular the said will goods chattels and credits and also the auditing allowing and final discharging the account thereof doth belong to us the administration of all and singular the goods chattels and credits of the said deceased and anyway concerning his will is granted unto Elijah Budd Executer in the said will named be being first duly sworn will and faithfully administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods goods chattels and credits and also to render a just and true account thereof when thereunto required.

In testimony whereof we have caused the seal of office of our said Surrogate to be hereunto affixed.  Witness Thomas Clowes Esquire Surrogate of the said county at the city of Troy the seventh day of December in the year of our Lord one thousand eight hundred twenty five.
